To TREAT a predator, posted by Robert Paisola


Should news agencies smudge journalistic ethics for higher ratings? MSNBC does not seem to mind - that is precisely what it does on its now infamous series of investigative reports on pedophiles, “To Catch a Predator”.

As host Chris Hansen smugly grills men on Dateline MSNBC “To Catch a Predator” he may or may not know that these men are (in most cases) neurologically compromised and are cursed with obsessive intrusive thoughts, which lead to behavioral responses most in the public do not want to believe: uncontrollable compulsions.

In a recently televised report Hansen and his team, as they routinely do, catch a middle-aged male who had been chatting with a decoy from PervertedJustice.com. Hansen repeatedly asks questions like, “Why are you here? Why are you doing this? Don’t you know this is wrong?” The guilt-ridden man writhes in shame and struggles to provide the impossible – a rational reason or excuse. The answer – the man’s brain is diseased.

Certainly, pedophilia particularly in the Internet age is a problem. It needs to be dealt with by legislating and enforcing laws that call for humane, evidence-based solutions to protect society.

The men shown on Dateline NBC exhibit symptoms of Obsessive Compulsive Disorder - dysfunction in a human organ - the brain. Similarly, diabetes is caused by dysfunction in a human organ – the pancreas. In both cases the organ does not create or regulate the correct amount of a vital biochemical. In the case of OCD, the neurotransmitter serotonin has been implicated by research. In both cases, medication has the capacity to regulate the irregular biochemical activity. If someone with diabetes does not take medications such as insulin they become ill and may die. If someone with OCD does not take their medications they can not control their impulsive thinking which leads to compulsive behavior.

OCD is no different in its basic etiology – it is hereditary and biological in nature, and society’s best chance at reducing pedophilia is to understand and accept its biological nature and design and implement interventions based upon evidence based medical psychiatric research.

The individuals’ lack of control is shown by MSNBC as they highlight several repeat offenders who admit to having seen “To Catch A Predator”, were wary of entering a trap, but came in anyway. Sane people don’t take those kinds of risks – people with diseased brains do.

This past June, NBC’s former Dateline Producer Marsha Bartel sued NBC for one million dollars for allegedly firing her for voicing ethical concerns about how the men seen on the show are solicited for entertainment. She alleges that NBC pays Perverted Justice to run what she calls “trolling operations” to lure men to homes to have sex with minors by using actors in internet chat rooms. She alleges that, “NBC unethically provides law enforcement with video equipment and video tapes.”

These men need help. In some instances it may need to be forced on them. Legislation is required to make mandatory neuropsychiatric treatments and police monitoring of computers and movement of these individuals. If Dateline MSNBC can “catch a predator”, certainly, as a society we can develop a system to “catch, treat and monitor a predator” rather than catch, humiliate, and profit off of a predator.

Although not as sexy, a constructive report would be to investigate whether or not legislation exists to enforce mandatory psychiatric treatment and police monitoring of perpetrators’ movements and their Internet activity. If such legislation exists, is it being enforced? Is it working? How can it be improved? Additionally, mandatory (chemical) castration should be debated and considered.

Utah Supreme Court justices acknowledged Tuesday that they were struggling on 13 year old having sex with 12 year old boyfriend , by Robert Paisola


Salt Lake City - Utah Supreme Court justices acknowledged Tuesday that they were struggling to wrap their minds around the concept that a 13-year-old girl could be both an offender and a victim for the same act - in this case, having consensual sex with her 12-year-old boyfriend.

The Ogden, Utah, girl was put in this odd position because she was found guilty of violating a state law that prohibits sex with someone under age 14. She also was the victim in the case against her boyfriend, who was found guilty of the same violation by engaging in sexual activity with her.

"The only thing that comes close to this is dueling," said Associate Chief Justice Michael Wilkins, noting that two people who take 20 paces and then shoot could each be considered both victim and offender.

And Chief Justice Christine Durham wondered if the state Legislature had intended the "peculiar consequence" that a child would have the simultaneous status of a protected person and an alleged perpetrator under the law.

The comments came in oral arguments on a motion asking the high court to overturn the finding of delinquency - the legal term in juvenile court for a conviction - against Z.C., who became pregnant after she and her boyfriend engaged in sex in October 2003.

State authorities filed delinquency petitions in July 2004, alleging that each had committed sexual abuse of a child, a second-degree felony if committed by an adult.

The girl appealed the petition, saying her constitutional right to be treated equally under the law had been violated.

Her motion noted that for juveniles who are 16 and 17, having sex with others in their own age group does not qualify as a crime.

Juveniles who are 14 or 15 and have sex with peers can be charged with unlawful conduct with a minor, but the law provides for mitigation when the age difference is less than four years, making the offense a misdemeanor.

For adolescents under 14, though, there are no exceptions or mitigation and they are never considered capable of consenting to sex.

A juvenile court judge denied the motion by Z.C., who then admitted to the offense while preserving her right to appeal to a higher court. The boy did not appeal.

The Utah Court of Appeals last December upheld the judge's refusal to dismiss the allegation, saying the law's "rigorous protections" for younger minors include protecting them for each other. Z.C. then appealed to the state Supreme Court.

At Tuesday's arguments, Matthew Bates, an assistant Utah attorney general, argued the prosecution of the girl was not unreasonable. He said the statute in question is designed to prevent sex with children who are 13 and younger, even if the other person is in the same age group.

By passing that law, legislators were sending a message, Bates said: Sex with or among children is unacceptable.

Randall Richards, the girl's attorney, argued that prosecuting children under a law meant to protect them is illogical.

"A child (victim) cannot also be a perpetrator in the exact same act," Richards said.

The Utah Supreme Court will issue a ruling later.

Mr. Paisola (hereafter referred to as Robert) grew up in a small, middle-class Ohio town. His father was a school teacher, then elementary school principle; the occupation from which he retired. His mother was a real estate agent. As a child his family joined and was bound by the ideals of the The Church of Jesus Christ of Latter Day Saints (Mormon). From this effort, he was offered a scholarship to the Broadcast Journalism Department at Brigham Young University where he studied broadcast journalism and business administration.

After a couple years at Brigham Young University, Robert discovered social hypocrisy. This hypocrisy enlightened Robert- dressing, looking and appearing they way one is told whether that is defined by an individual’s parents, the church or society as a whole was an intolerable way for him to live. Robert then decided to leave university to pursue his ideals of entrepreneurial discovery, expression and strategy.

Forming Credit Control Corporation with friends from B.Y.U., Robert led the organization by the soft touch approach- people pay their friends, not their enemies. As a twenty-something year old, Robert learned the hard lesson of not being a watch dog over his employees. Credit Control Corporation was involved in legal issues surrounding insurance fraud. Knowing that his original ideal was to live a life as an open-minded, accountable individual, Robert accepted his responsibility as the CEO of Credit Control Corporation and pleaded guilty to the fraudulent actions of his actions and those who worked under Robert and the behaviours that he overlooked or was unaware. He believed he could trust other individuals to run his business and played as most twenty-something year olds do- fast, expensive cars, a vast home and all the materialism that most individuals believe is the essential ingredient to a happy life.

After taking accountability for his company, Robert found himself in Lompoc Federal Correctional Complex. While at Lompoc, Robert worked and spent 90% of his time in the law library, studied the process and ideals of justice, met with some of the most brilliant minds in the world, who, like Robert, used their talents erroneously, including Kevin Mitnick, and here world-renowned computer hacker now working as a computer security consultant, and Michael Milken, American financier influential in developing the junk bond market and an institutional philanthropic genius. Milken now donates copious amounts of time and money to charitable causes. His estimated worth as of 2007 is $2.1 billion.

Voraciously reading, studying and learning not only law, he examined the uniqueness and learned from the varied individuals with whom he spent his time. Robert was a model inmate. He earned respect from his new found friends- fellow inmates and employees of Lompoc Federal Correctional Complex.

Released early for exceptional behaviour, Robert was given five dollars, a plane ticket to return home and wished, “Good luck!” Robert realized that he had to begin again with nothing. From his experiences and relationships at Lompoc, Robert began his understanding of the lack of promise and hope from “prison rehabilitation.” Depressed and confused and not knowing which direction to turn, Robert, with nothing but the hope of luck, attempted to begin his life anew by misinforming loan applications- just until he could get ahead. “If I could have just got one break, I would have paid every dime back. I had nothing but the new view of life without rose-colored glasses.”

Robert didn’t get a lucky break, instead he returned to Lompoc. Again, Robert was the model inmate and returned to work in the law library. This time there were no typewriters; there were computers and a new phenomenon known as the Internet. With Robert’s prodigious appetite for learning, he began his new educational endeavour- surfing the Internet, learning about people, places and things from all over the world.

The mid 90’s through 2003, very few protective measures were in place by the W3C (World Wide Web Consortium). Thousands of people were misrepresented, including Robert, by the content that was included in photo sharing programs www.photosucker.com as well as the overly invasive pop-up windows even more prominent in the late 1990’s than now. An investigation of his computer’s hard-drive included hundreds of pictures sent to him by friends, but also included pictures bundled from photosucker.com and uncontrollable pop-up ad history which were defined, at that time, as child-pornography.

Robert, again taking accountability, plead guilty to possession of child pornography. He was and is bold in his plea that, “Yes, this is my computer on an unsecured network. I am therefore ultimately responsible for my property although this property contains images which were not viewed, used, passed along nor satisfied any concept of personal sexual fulfilment or deviation.”

Robert was evaluated by the Federal Psychological Committee and was unanimously determined to be an individual that does not conform to any definition of a sexual deviant, pedophile, or threat to society or children.

Handed a plane ticket for the second time, Robert returned home to Utah. This time he realized that “prison reform” is a guise for a process that is realistically adult baby-sitting. He knew that he could not take chances anymore. He knew that to move forward in life he had to define his values, pay his debt to those who were misled by his employees at Credit Control Corporation, realize and forgive himself for his mistakes and accept that he had paid his debt to society.

Robert’s second term at Lompoc began his journey of redefining the self-discovery of his college years and realizing that the road he followed, with all its twists and turns, assisted his awareness of the importance of accountability, but more importantly he began wrapping his mind around the façade of approval-based living. Materialism and wealth at any cost was not his true desire and certainly not his true mission and talent in life.

Obtaining knowledge through self-study and graduating from The University of Life, Robert began working with friends from college and utilized his remaining legal resources and connections to assist consumers with debt consolidation and harassment issues. In a decision to distance himself from the false earnestness of consumer debt collection and licensing, Robert refused $750 million dollars worth of consumer debt collection contracts from various companies. Robert holds steadfast to his principle of working for those who want to understand the process of debt collection and those individuals who work for debt collection agencies. Robert has acted as a liaison for collection agencies. He, being the one who would have to work on behalf of contracted companies to pursue those who were delinquent on their debts, Robert renumerated on the mistakes of his company, Credit Control Corporation. After months of analyzing and learning from his personal past, he made the conscious decision to refuse to work with organizations that insist upon collecting debt from individuals with no regard personal circumstances or well-being.

Understanding the condition of “moral bankruptcy” and cause and effect of distorted morality, Robert now works as a liaison with associates and executives from various sectors of private and public businesses who are in need of debt consolidation or collection assistance and business restructuring. Singer's lawyers have slowed things down, but tours, heavy caseloads and medical emergencies are partly to blame for six-year wait.

In the last six years, Michael Jackson was charged, tried and acquitted of child molestation. Phil Spector was charged and tried for murder (and due to a mistrial, he'll have to do it all again). Lil' Kim was charged, tried and convicted of conspiracy and perjury, and she even found time to shoot a reality show while she served her sentence.

So what's taken R. Kelly so long? The R&B singer was charged with child pornography back in June 2002, and it's taken until Friday (May 9) for jury selection to begin. Along the way, there have been moments when a trial seemed imminent — a trial date was even previously set for September 2007. But something always seemed to get in the way, and that delay has only helped serve the defense — as memories fade and the alleged victim looks less like the girl on the tape and more like a grown woman.

But the delay, a rarity in non-capital cases, is not all Kelly's doing. Yes, his defense team had a hand in it, first and foremost because Kelly waived his right to a speedy trial. He's always had the option to invoke that rule, which would mandate that the case begin in four months or be dropped. Instead, Kelly's high-priced lawyers have used the wait to their advantage, filing more than 30 pre-trial motions that then had to be answered by prosecutors and argued in court.

If you got wind of any of those hearings — in one, a childhood friend of the alleged victim testified — you might have thought the trial was already taking place, what with the intensity of the arguments and the scrutiny of evidence and witnesses. But, no, they've just been deciding which evidence will be admissible (such as the sex tape at the heart of the case), when the tape could have been made and which expert witnesses will be allowed to testify about which subjects (forensic pediatrician Dr. Sharon Cooper, for example, can testify as to the age of the girl but not to her state of mind). These arguments have taken years.

The process has also been interrupted by a couple of unavoidable hiccups. Judge Vincent Gaughan fell off a ladder and broke his back in the summer of 2006. R. Kelly's appendix burst in February 2007. The lead sex-crimes prosecutor had a baby late last summer. Then one of Kelly's lawyers, R. Eugene Pincham, died this April.

Since Kelly's trial wasn't the only thing happening in Chicago, key people involved have had to juggle multiple caseloads. Gaughan has been presiding over the Brown's Chicken trial, in which two men were charged of killing seven people in an eatery in 1993 (one was found guilty last May; the second is expected to stand trial this summer). Kelly's lead attorney, Ed Genson, also had big fish on his plate: Since Kelly was indicted, Genson has also defended alleged Russian mobster Boris Stratievsky, "America's Most Wanted" fugitive Margaret DeFrancisco (on murder charges), car-dealer Bruno Mancari (on a charge that he hired a hit man), former Illinois Governor George Ryan's cronies Larry Warner and Scott Fawell (on corruption charges) and media mogul Conrad Black (on federal charges of obstruction of justice and mail fraud).

Often, the arguments that were scheduled to be heard in the Kelly case were tabled so that the singer could ask for permission to tour — which the court usually granted, so as not to deny him means to pay for his defense. At different points in 2004, 2005, 2006 and 2007, people projected that the trial would start that year, only to see it pushed back again and again.

In December, Kelly missed a court date because he was still in Utah on his tour bus. At the time, the judge was furious, and threatened a bench warrant. "These are extraordinary matters to have these breaks given to you and then nobody shows up," Gaughan said. Assistant State's Attorney Shauna Boliker chimed in: "The leeway the court has given him to go on a 45-city tour, to do whatever he pleases ... the very least he could do is be here for his appointed court date."

Kelly will presumably be there for the trial, which appears likely to begin on Friday as scheduled. His lawyers continue to pepper the courts with requests to stay the proceedings, with one attorney, Sam Adam, asking the Illinois Appellate Court, and Genson asking Judge Gaughan directly on Wednesday. Adam's reason is that he wasn't officially allowed to be part of the defense team after refusing to sign a court order saying he would re-interview witnesses, while Genson's reason is that recent publicity makes it difficult to find prospective jurors. Gaughan is expected to rule on the latter on Friday.

So, if you're wondering what the real holdup is, blame paperwork.

Show business is about idolization. As an idol to tweens the world over, singer-actress Miley Cyrus, 15, is riding a huge tidal wave at the pinnacle of her career; this is as it should be. I hope she enjoys it. I guarantee there will be many bumps in the road ahead. One of them, especially for somebody who acts and sings on her own TV show, is that your image becomes cryogenically frozen into a specific stereotype.

Within three to five years, Miley will have to face adulthood. Fans grow up, and their youthful interests quickly dissolve. Her challenge will be overcoming the Hannah Montana stereotype. Miley's fans are not thinking about the fact that she will grow up too. As she does, she'll want to change her image, and that change will be met with adversity. It's next to impossible to fight, embrace, use or love your image. Trust me. I've seen this all play out before; it's the same ball game, just different players in a different time.

But Miley has an amazing support team. She seems to have good Christian values, with parents (including dad Billy Ray) teaching her important life lessons. She has management that has seen this phenomenon through before—Jim Morey's company—Jim managed me during my Puppy Love days. I hope Miley enjoys every minute of this brief experience before her inevitable reinvention takes place. It's going to make a fascinating book someday. I'll read it.

Utah's sex-offender registry is expanding with the addition of people convicted of crimes that have nothing to do with sex.

Kidnapping has been added to the list of crimes that require registration, although there is an exception for parents convicted of taking their children.

Beginning Monday, the Utah Sex Offender Registry will require convicts to also provide more information.

"If the Web site says they have a red Ford and they paint it gray, we need to know that. I think these are common-sense issues," said Rep. Paul Ray, R-Clinton, who sponsored the law approved in the 2008 legislative session.

He said the changes are taken directly from federal mandates, but some critics are concerned that lawmakers have gone too far.

"The Legislature does some weird things. It's government as a reactionary body doing what it thinks will keep its constituency happy," said Roy Cole, a public defender in Ogden.

Cole said adding other crimes to the registry is a mistake. The new crimes are kidnapping, child kidnapping, aggravated kidnapping and unlawful detention.

"The first person who challenges that is going to win. How do they qualify as sex crimes?" Cole said. "The reality is [they] rarely have anything to do with sex. It's a false media stereotype you see on TV that someone down at the Legislature has bought into."

Utah's registry contains about 6,900 names. Half of the people are under active supervision by the state.

Under the new requirements, offenders must provide their license-plate numbers to other information, which includes the color, make and model year of their vehicles. Boats and planes must be reported.

Offenders must list any state licenses, ranging from medicine to private investigation. Offenders who volunteer at schools must name the school.
